How long does my landlord have to return my security deposit?
It depends on your state. Among the 44 states with a fixed return period, deadlines run from 14 days (Alaska, Hawaii, Nebraska, New York and Vermont) to 60 days (Alabama and West Virginia). The calculator above gives a date for those states and the statute to read for the rest.
What happens if my landlord misses the deposit return deadline?
Some state laws allow a penalty on top of the deposit when a landlord misses the deadline or keeps money it wasn't allowed to keep, and some also allow attorney fees. What triggers a penalty depends on the state, and a court decides whether it applies.
Can my landlord deduct cleaning fees from my deposit?
Only if the unit was left significantly dirtier than move-in condition and your lease requires you to leave it clean. Normal wear and tear — minor scuffs, small nail holes, faded paint — cannot be deducted.
