By accessing or using DepositHawk at deposithawk.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Nature of Service — Not Legal Advice
DepositHawk provides legal information tools based on publicly available statutes and state housing code data. THE SERVICE DOES NOT CONSTITUTE LEGAL ADVICE.
DepositHawk is not a law firm. No attorney-client relationship is created between you and DepositHawk by your use of this Service. No attorney-client relationship is created at any time, for any reason.
Generated documents — including demand letters, filing guides, and evidence checklists — are based on publicly available legal information and are provided for informational purposes only. These documents are not reviewed by licensed legal professionals and may not be appropriate for your specific situation.
The accuracy of legal information depends on current state statutes, which change frequently. Users should independently verify all information against current law before relying on or acting upon it.

3. Use of Generated Documents
You are solely responsible for reviewing all generated documents — including demand letters, filing guides, and evidence checklists — before using, sending, or filing them. DepositHawk makes no representation that any generated document is complete, accurate, or appropriate for your specific circumstances.
DepositHawk is not responsible for any outcome — including unfavorable judgments, missed deadlines, dismissed claims, or landlord responses — arising from your use of documents generated by the Service. You use all generated documents at your own risk.
You agree not to misrepresent the source of generated documents or to submit documents containing information you know to be false.
4. Payments and Refunds
Paid plans (Demand Letter and Full Case) are one-time purchases that grant immediate access to the corresponding generated documents. Payments are processed by Stripe, Inc. DepositHawk does not store your payment card information.
All sales are final. Because our Service delivers digital goods immediately upon payment, we do not issue refunds except in cases of documented technical failure on our part. If you experienced a technical issue that prevented you from receiving the service you paid for, contact us at support@deposithawk.com within 7 days of your purchase.
5. Privacy
Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in that policy.
6. Accuracy of Information
Legal data provided by DepositHawk is based on state statutes, regulations, and housing codes as of 2026. Laws and regulations change frequently and without notice. DepositHawk does not warrant that any information provided through the Service is current, complete, or accurate at the time you access it.
DepositHawk is not responsible for any damages, penalties, or adverse outcomes resulting from your reliance on information that has since been superseded, amended, or repealed. You are responsible for verifying all legal information with current, authoritative sources before acting on it.
7. Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. DEPOSITHAWK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEPOSITHAWK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF A SECURITY DEPOSIT, ADVERSE COURT JUDGMENTS, ATTORNEY FEES, OR ANY DAMAGES ARISING FROM YOUR USE OF OR RELIANCE ON DOCUMENTS GENERATED BY THE SERVICE, EVEN IF DEPOSITHAWK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
DEPOSITHAWK’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO DEPOSITHAWK IN THE 12 MONTHS PRECEDING THE CLAIM.
8. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. DepositHawk is operated by PromptCritical LLC, a Delaware limited liability company. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
